Terms of Service.

By accessing, browsing, or utilizing the web applications, mobile interfaces, or platform services operated at maanthan.com (collectively, the "Platform"), or by authenticating via Mobile One-Time Password (OTP) to activate your Talent Passport, you (the "User", "Candidate", "Data Principal", or "Recruiter") agree to be legally bound by these Terms of Service (hereinafter referred to as "Terms").

These Terms constitute a legally binding agreement between you and Maanthan Global Solutions Pvt. Ltd. (hereinafter referred to as "Maanthan", "Company", "We", "Us", or "Our") under the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Digital Personal Data Protection (DPDP) Act, 2023. If you do not agree to these Terms, you must immediately cease accessing or using the Platform.

Maanthan operates an AI-powered talent ecosystem, career matching infrastructure, and professional credential verification network. Services provided via the Platform include:

• Talent Passport Creation: Generation of structured, digital candidate profiles featuring AI skill vector scoring, career histories, and verified credentials. Candidates maintain view access to their own AI career insights, while employers view aggregated skill match scores.
• Staging Sandbox & Consent Gate: Sourced candidate data evaluated by authorized executive search partners and recruitment consultants is initially held in a locked, non-public Staging Queue (0% visibility to external employers). Profiles become searchable only after the candidate completes Mobile OTP authentication and accepts these Terms and our Privacy Policy.
• Recruitment & Verification Workflows: B2B tools enabling verified corporate employers and recruiters to discover matched talent, request contact reveals, and manage candidate shortlists.

• Age Qualification: You must be at least 18 years of age (or the legal age of majority under applicable Indian law) to register an account, claim a profile, or activate a Talent Passport on the Platform. Maanthan does not knowingly permit access to minors.
• Account Credentials: You are solely responsible for maintaining the confidentiality of your mobile number, OTP access codes, passwords, and account credentials. Any activity conducted under your account shall be deemed authorized by you.
• Accuracy of Information: Users agree to provide true, accurate, current, and complete information regarding their identity, educational qualifications, employment history, and professional certifications. Submitting falsified resumes or fraudulent credentials constitutes a material breach of these Terms.

Maanthan enforces zero tolerance for platform misuse, unauthorized data extraction, or candidate privacy violations.

You expressly warrant and agree that you shall NOT:

• Scrape or Automate Data Extraction: Use spiders, bots, scrapers, crawlers, automated scripts, or software to extract, mine, collect, or index candidate profiles, resume databases, phone numbers, or platform metadata.
• Unauthorized Export or Local Device Storage: Download, bulk-export (via CSV, Excel, or PDF), screen-record, print, copy, sell, trade, or store candidate resumes or contact details onto personal or unauthorized local devices outside of approved recruitment workflows.
• Bypass Security Measures: Attempt to breach, probe, bypass, or disable the Mobile OTP consent gate, staging queue security protocols, encryption algorithms, or role-based access controls (RBAC).
• Platform Interference: Upload viruses, malicious code, malware, or engage in denial-of-service (DoS) attacks that impair the availability or performance of the Platform.
• Misrepresentation: Impersonate any person or entity, or falsely claim affiliation with Maanthan or any corporate hiring client.

Recruiters, corporate hiring managers, and sourcing consultants accessing candidate data via the Platform agree to the following statutory and contractual duties:

• Purpose Limitation: Candidate data accessed via the Platform must be used solely and strictly for bona fide recruitment, executive search, and employment evaluation for legitimate job openings.
• DPDP Compliance: Employers must handle all candidate digital personal data in strict compliance with the DPDP Act, 2023. Candidate profiles accessed via Private/Anonymous Mode must not be deanonymized without obtaining explicit candidate permission through the Platform.
• Account Liability & IT Act Penalties: Corporate accounts or individual users found misusing data, exporting bulk candidate lists without legal authorization, or attempting to sell data to third-party data brokers will face immediate account termination, forfeiture of subscription fees, and legal prosecution under Section 43 and Section 72A of the Information Technology Act, 2000.

All intellectual property rights associated with the Platform—including but not limited to software code, website designs, AI match scoring algorithms, "Maanthan Score" methodologies, "Talent Passport" structural frameworks, graphics, user interface (UI) layouts, logos, and trademarks—are the sole and exclusive property of Maanthan Global Solutions Pvt. Ltd.

Nothing in these Terms grants you any ownership, license, or right to use Maanthan’s intellectual property without our express prior written authorization.

Your use of the Platform is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the Platform, you acknowledge that non-essential analytics tracking (such as Google Analytics and Mixpanel) executes only upon your explicit opt-in via our website Cookie Banner, and that you retain full statutory rights as a Data Principal under the DPDP Act, 2023.

• No Guarantee of Employment: Maanthan provides an AI-powered talent ecosystem and matching platform. Maanthan does not guarantee job placement, interview calls, candidate selection, or specific salary offers. Hiring decisions rest solely with prospective employers.
• "As-Is" Service: The Platform and all associated content, algorithms, and features are provided on an "As-Is" and "As-Available" basis without warranties of any kind, whether express or implied.
• Limitation of Liability: To the maximum extent permitted under applicable Indian laws, Maanthan, its directors, officers, employees, search partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, loss of data, business interruption, or system downtime—arising out of or in connection with your use of the Platform.

You agree to indemnify, defend, and hold harmless Maanthan Global Solutions Pvt. Ltd., its directors, officers, employees, recruitment partners, and affiliates from and against any claims, liabilities, losses, damages, demands, penalties, or expenses (including reasonable legal fees) arising out of:

• Your breach of any provision of these Terms, the Privacy Policy, or applicable laws (including the DPDP Act, 2023 and IT Act, 2000).
• Any false, misleading, or fraudulent information provided by you on the Platform.
• Your unauthorized extraction, downloading, scraping, or misuse of candidate or platform data.

Maanthan reserves the right, in its sole discretion and without prior notice or liability, to suspend, disable, or permanently terminate your account or platform access if:

• You breach any provision of these Terms, the Privacy Policy, or executed non-disclosure agreements.
• We detect unauthorized data scraping, bulk resume exporting, or security bypass attempts.
• Required to do so by court order, law enforcement agency, or regulatory authority in India.

Upon termination, your right to access the Platform immediately ceases, and any pending draft profiles or accounts may be deactivated or deleted in accordance with our data retention procedures.

These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India.

Any legal dispute, suit, action, or proceeding arising out of or relating to these Terms, the Platform, or services provided by Maanthan shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.
